California law provides significant protections to residents of rental property who are victims of domestic violence or other violent crimes. The legislature has determined that victims of domestic violence should not lose their housing solely because of abuse or calling for assistance from law enforcement. However, the law also recognizes that in some cases it may be best for the victim to relocate – and to be released from the financial obligations of a lease. These protections were recently extended to victims of violent crime (not just domestic violence) and to residents who need to move because their family member who lives elsewhere was the victim of a violent crime or domestic violence. The protections were further expanded as of January 1, 2023, to protect victims of domestic violence who previously shared tenancy with the perpetrator and those who previously lost protection because the perpetrator returned to the property without the victim’s consent or for child custody exchanges. In 2016 the Mountain View voters approved Measure V, the Community Stabilization and Fair Rent Act (CSFRA), which enacted a system of rent controls and eviction restrictions in the City of Mountain View. The CSFRA took effect on December 23, 2016. Under the CSFRA rent increases for covered units are tied to inflation, as measured by the Consumer Price Index.  The CSFRA also provides protections against eviction for tenants in covered units.

In the past two weeks, the Los Angeles County Board of Supervisors and Los Angeles City Council adopted new laws that dramatically impact how you provide housing in Los Angeles. 
 
The Los Angeles County Board of Supervisors extended the eviction moratorium through March 31, 2023 for ALL rental units across the county.  The Los Angeles City Council adopted new limits on evictions, new restrictions on rent increases for ALL rental units in the city that aren’t rent controlled redefined what it takes for a tenant to be considered late on their rent.

State and federal fair housing laws prohibit discrimination against families with children under 18. In addition to prohibiting an outright denial of housing to families with children, fair housing laws also prohibit housing providers from imposing unreasonable requirements or conditions on tenants with custody of children, such as:

New Proposition 65 regulations for the rental housing industry take effect July 1, 2019. Proposition 65 requires every business with ten or more employees to provide warnings prior to exposing any person to a chemical known to the State of California to cause cancer and/or birth defects or other reproductive harm. If you follow the news, you probably notice that California appears to be in a constant state of emergency. Whether due to fires, severe storms, earthquakes, or pandemics, both the Governor and local officials have declared countless states of emergency over the last several years. Those emergency declarations trigger a provision of the state’s penal code, called the state’s anti-price gouging law, which limits how much rental housing providers can increase rent. And those limitations apply not only to your existing tenants but also to new tenants even in units that are new to the rental market. A violation of this law is a misdemeanor and subject to significant penalties.

Did you know that before 1996, it was legal for cities in California to control how much a vacant rental unit could be listed for? That, and more, changed with the adoption of the Costa-Hawkins Rental Housing Act in 1995. This little-known law provides critical protections for every single rental housing provider in the state, and especially for small mom and pop housing providers. Yet, few property owners know of its existence and even fewer are aware of the numerous attempts in recent years water-down, bypass, or repeal it altogether.

The COVID-19 Tenant Relief Act of 2020, commonly known as AB 3088, was passed by the California Legislature on Monday, August 31, 2020 and took effect immediately upon signature by the Governor. AB 3088 provides sweeping new protections from eviction for tenants unable to pay rent and other charges due between March 1, 2020 and January 31, 2021 due to circumstances directly related to the COVID-19 pandemic. It also extends the “just cause” protections of the Tenant Protection Act of 2019, commonly known as AB 1482, to all properties through January 31, 2021.
